After New York Defies Supreme Court Ruling – Second Amendment Foundation Files Federal Lawsuit

What’s Happening:

Over the Summer, the Supreme Court ruled in favor of gun owners. They decided restrictive gun policies in New York State violated the Second Amendment.

But did the governor go ahead and comply with the court’s ruling? Nope! In fact, the state made it even harder.

The “Concealed Carry Improvement Act” (“CCIA”) ostensibly allows some people—still very few in number—to obtain a concealed handgun carry license. But even for the seemingly lucky ones, it comes at a severe cost…

The language of the CCIA is sufficiently vague to support the conclusion that a person isn’t permitted to use a handgun for self-defense outside the home, even with a valid concealed handgun license in tow.

The state amended its gun control law, but then made it so nobody who has a concealed carry permit can effectively use their gun for self-defense.

Thus, nullifying the very reason the Supreme Court made its decision.

But Second Amendment supporters are not taking this lying down.

The Second Amendment Foundation today filed a federal lawsuit challenging a new gun control law adopted in New York State following the Supreme Court’s nullification of its previous concealed carry state that required “proper cause,” alleging the state’s new statute is just as unconstitutional as the previous law.

Why did anyone think a state as blue as New York would comply with a pro-Second Amendment ruling?

Even though NY removed the restricting language from its concealed carry law, lawmakers made it so permit owners can’t carry their guns.

The new law makes it so most places in New York are “sensitive,” meaning they can’t carry their firearms.

The governor herself stated that New Yorkers won’t be allowed to carry their guns outside their homes, making concealed carry permits worthless.

This is going much further than their previous law. So, the Second Amendment Foundation sued them.

They are taking this case directly to the federal courts, demanding this state law be overturned.

It could, once again, go to the Supreme Court, which might have to make a stronger decision in support of gun rights.
