Every American enjoys the right to freedom of speech under the Constitution. The First Amendment is a guarantee of free speech, and this right can’t be taken away for frivolous reasons such as being offended by another person speaking freely.

The problem in the country today is that many people in powerful government positions believe they can strip away the right to free speech on a whim. This tends to happen when liberals in any position of power get their feelings hurt.

Former President Donald Trump knows how to make liberals cry and he didn’t stop when he was attacked by liberals with the criminal hush money trial in Manhattan. The native New Yorker took aim at the prosecutors and trial judge, and his fiery speech angered them greatly. This prompted the judge to issue a gag order against Trump, effectively eliminating his right to free speech.

Now the judge is facing consequences from another branch of government that can defend Trump’s rights. The judge may not like what happens next where he could be on the front end of a criminal investigation.

Sen. JD Vance, R-Ohio, is demanding a criminal investigation into New York Supreme Court Justice Juan Merchan over his enforcement of gag orders against former President Trump during his trial.

The Ohio Republican, a strong advocate of the former president, called on Attorney General Merrick Garland to open an investigation into Merchan, specifically for depriving Trump of his First Amendment right to free speech.

“The public evidence suggests that an investigation is warranted at least. And all indications are that the responsible parties have their sights set, not only on rights protected by the Constitution, but on rightsholders of core federal concern, including the leading candidate for the presidency,” Vance wrote in a letter to Garland.

Vance cited statutes he said apply to uncovering whether Merchan violated the law. One statute prevents conspiracies to “injure, oppress, threaten, or intimidate” others who enjoy federally protected rights. Another prohibits anyone from “willfully [depriving] a person of a right or privilege protected by the Constitution or laws of the United States.”

Vance was harsh in his criticism of the judge and his actions during the trial.

“On Merchan’s orders, a Republican presidential candidate has been made powerless to question the credibility of the witnesses testifying against him, the motivations of the prosecutors pursuing him, or the impartiality of the apparently conflicted judge fining him,” Vance claimed.

The Republican senator also suggested that Merchan tried to prevent the former president from being able to seat an impartial jury. Vance stated that the judge refused to dismiss prospective jurors who held an obvious bias.

Vance’s calls for a criminal investigation against Merchan follow claims from fellow Republicans and Trump who have criticized the prosecution, the charges, and Merchan. All have referred to the case as “election interference.”
