Trump’s attorneys say their client was entitled to keep such records when he returned to his Mar-a-Lago home in Florida, arguing the Presidential Records Act gives him the authority to designate the documents as personal and keep them.

Biden’s prosecutor claims Trump illegally kept records from his time as president, despite protections under the Presidential Records Act. Trump’s team claims the case should be thrown out because he is protected.

Now, the judge overseeing the case struck a blow against prosecutors by allowing arguments over Trump’s request.

The prosecutor leading the case, who is accused of being an anti-Trump Democrat, claims the Presidential Records Act does not protect Trump. His claim is that the records he kept were not personal.

But nearly every president (and a few vice presidents) has taken thousands of documents with them when they left office. Obama took over 30 million records, some of which came from the Clinton administration.
