What’s Happening:
It looks like Democrats are putting all their eggs in DA Bragg’s basket. The liberal district attorney has charged Donald Trump with 34 felony counts of falsifying business records with the intent to commit another crime.
Most legal experts have dismissed the validity of the case. But it is unclear if the judge will throw it out or if a jury will actually convict a former president on such flimsy charges. Bragg is convinced Trump was trying to cover up another crime. But what was that crime? Why hasn’t Bragg charged him for that, if it is so critical to this case? He refuses to say. And that might be his undoing.
From Fox News:
Former President Donald Trump’s Sixth Amendment rights may have been violated when New York County District Attorney Alvin Bragg refused to disclose the underlying crime the defendant intended to conceal…
When questioned by a reporter as to what the underlying crime the indictment fails to name is, Bragg replied in New York State, he does not have to.
“The indictment doesn’t specify it because the law does not so require,” he told the journalist
On “Hannity,” Fox News legal analyst Gregg Jarrett forcefully dismissed Bragg’s claim, saying he likely violated Trump’s right to know what he is specifically being accused of.
So, Bragg’s entire case hinges on the claim that Trump falsified business records with the intent to commit another crime. Which means, the weight of the case really depends on that “other” crime. But Bragg did not disclose what that crime was. Nor is he even willing to say what he thinks Trump did.
Bragg said the law does not require him to say what crime he thinks Trump committed. But according to the Sixth Amendment, a defendant has the right to “be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor…”
Instead, Bragg is hiding what crime he thinks Trump committed. Is it possible he doesn’t know? If he knew Trump committed a real, punishable crime, why not charge him for that? Instead of turning misdemeanor crimes into felonies.
Legal experts seem pretty clear on this issue. To hide what the crimes were is a violation of the Sixth Amendment. Bragg doesn’t seem to even understand this point of law. But will Trump’s lawyers argue this in court, to get the entire case thrown out?
We don’t know. At the very least, Bragg needs to reveal what he thinks Trump is really guilty of. Otherwise, this entire thing is a sham from the start. We all know he is doing this to prevent Trump from winning the election.
The only person not admitting that is Bragg.
Key Takeaway:
- Legal experts are accusing DA Bragg of violating Trump’s Sixth Amendment rights.
- The 6th requires defendants to know what crimes they are being accused of.
- Bragg refuses to say what crime he says Trump tried to commit when he “falsified” business records.
